USCCA Pulls Out Of New Jersey

It recently came to our attention that the US Concealed Carry Association recently had to pull their services off the shelf for New Jersey gun owners due to the actions of governor Phil Murphy. 

Governor Murphy signed an executive order that directed New Jersey’s Department of Banking and Insurance to prohibit the sale of “insurance products that encourage the improper use of firearms.”

On Sept 10, the governor of New Jersey, Phil Murphy, signed an executive order directing New Jersey’s Department of Banking and Insurance to prohibit or limit the sale of insurance products that encourage the improper use of firearms.  

Now, USCCA membership isn’t insurance, and you and I both know our membership does not encourage the improper use of firearms but it appears the State of New Jersey may not agree with us.  As such, we have received a notice of inquiry from the state of New Jersey about our membership program. 

To ensure our long term ability to provide membership to as many responsibly armed Americans as possible, we are suspending selling new memberships and renewing existing memberships in New Jersey as we work our way through this state inquiry.

This is sadly not the first time this has happened. USCCA also recently had to pull out of both Washington and New York states for similar reasons.

We always recommend that you stay covered as long as you can, in case you ever find yourself up that proverbial creek. What this means, is that you must use another company once your USCCA coverage runs out. The problem here, is that when USCCA pulls out of a state, most of their competition follow suit pretty quick. The keyword there, is “most.” 

More on this in a moment. But first, let’s discuss what the problem is for USCCA and some of the others.

The problem, even though they’re not “insurance” as far as the traditional definition of the word describes, they do list each member as a beneficiary of their coverage. Because they list beneficiaries, they’re regulated a lot like a regular insurance company is. Therefore, when state officials are told to limit or prohibit any insurance for “improper use of firearms,” they’ve got no choice to pull out, or get into some sort of trouble with that state which they obviously don’t want to do. 

The only company who doesn’t usually pull out of a state because they’re set up a lot differently is CCW Safe. CCW Safe is a form of “captive insurance” where there are no beneficiaries listed. If you need to use your firearm in defense of life, as a member you contact them and they cut a check directly from their own bank account. 

Because of this, they’re not held to the same regulations as the rest of these companies are. I suggest that if you’re a member of USCCA, US Law Shield, or one of the others, that you compare the coverage you get in our chart

    How does carry “insurance” “encourage the improper use of firearms”? Isn’t use of a firearm for self defense the proper use of a firearm? Isn’t that, at least in part, what Heller provides? Sounds like an unconstitutional order waiting for a law suit!

      Jeff, I think that is part of the problem. There are not enough lawsuits in response to such constitutional breaches against gun owners. I can see CA and OR immediately following such steps. If the gun owners do not respond soon they will not have the option.

      Yeah, but that won’t work. What happens in New Jersey doesn’t stay in New Jersey (or New York, or California, or MA).

      People used to move from Cali and NY to MA because it was affordable and there were jobs. They also wanted all the free stuff they had in Cali or NY, and voted accordingly. Now taxes are outrageous, guns are all but banned, and all those people are moving on to NH.

      Wash, rinse, repeat. Move from place to another and bring your ideology with you. Leaving nothing good behind.

      Because 2A people don’t often make a real fuss by showing up on the statehouse steps, this is going to happen everywhere unless we start fighting it where it starts. Like in New Jersey.

    To me that governor couldn’t be more wrong. Having what the USCCA provides is what responsibly armed gun owners and concealed carry licensees is all about, that is being responsibly armed and taking steps to show people that you are a responsible person and understand your second amendment rights as an American with inanielable God Given Rights.

    Maybe if USCCA, NRA and all other gun owner associations throughout the nation brought
    a class action law suit against New Jersey, Washington & New York, & take to the Supreme court if necessary, chances are this illegal action by those states could be over turned.

    What an idiotic decree. It needs to be challenged by the U.S. Supreme Court. As previously mentioned, how is this any different from Auto Insurance, Home Insurance (encourages setting one’s house on fire???) etc. We need common sense Government Officials in Office and term limits also.

    USCCA did the same thing in Washington State and USCCA opted to not renew my membership so I went to US Law Shield, how is it they can work in these states that USCCA cannot?

      Steve, I wondered the same thing. The article seems to imply that US Law Shield and USCCA are both seen as insurance companies, so why will Washington State allow US Law Shield and not USCCA? I’ve been with US Law Shield for a couple of years, and they always talk about how they are not an insurance company. None of this makes sense.

    I agree with Robert Murphy and am afraid other left wing governors will do the same thing in their states. Once this happens the dominoes fall quickly. Instead of fleeing it is paramount USCCA take a stand in our highest courts to continue offering the protection and trading tools we have come to respect as legal gun owners. Nip it now and fight for yourselves as you have done for so many. We are in full support.

    This is very disappointing. I would think that this organization should step up and fight for gun owners in New Jersey and any other state that attempt to violate a U.S. citizens right to have a firearm. How soon will it be before all the states follow and do the same thing! There have to be some brilliant Constitutional minds that could work in conjunction with the many firearms advocates, NRA, to protect the freedom of the U.S. citizens!

    So the ,( ANSWER ), Appears that USCCA could easily fix their own internal or external problem by not calling your company an insurance company !

    Change to a company at maintains legal attorneys services for the use of legal services to defend USCCA clients.

    Get rid of any thing that has beneficiaries titles or family survivor benefits !

    It’s a personal retention of lawyer services throughout the United States to protect your USCCA CLIENTS ‼️

    I’m NOT an attorney but this could be the easy fix .

    It’s kind of like F.O.P for police officer that need attorneys due to their circumstances in their jobs. It’s NOT INSURANCE ‼️

    It’s is for legal services only !

    This is the first I’ve heard about USCCA pulling out of states. It scares me that this is even allowed. We are loosing our 2nd Ammendment rights faster than ever before. How is this even possible? Who and what are undermining our rights and freedoms that the Constitution gave us. Are we to become a dictatorship? We legal americans need to FIGHT!!!! NOW!!!

    A little over a year ago I informed you that I was covered by CCW insurance from a company called Second Call Ins. When it came time to renew I attempted to access my online policy. I got a message that I no longer had a policy with them. I received a notice in the mail some time later that there policy’s were under written by Loyds of London and they had dropped NJ policies as did Shield when I inquired with them.
    I never attempt to join in gun buys or giveaways.

    There has been much liberal chatter about requiring firearm owners to carry insurance. I wonder how they square that with NJ’s idiot governor’s executive order. We escaped from NJ after living there 38 years and one day after retirement. We actually liked NJ then, but it became a schiff-hole state.

      Wondering about that in NY every year assembly puts forth legislation to require gun owners to carry insurance but Cuomo directed DFS to go after companies that were insuring gun owners… bottom line is dems want to disarm all.

    I see it as the left legalizing the intimidation of gun owners. They will hope bogus “red flag laws” will teach gun owners to get rid of their guns out of false legal liability, along with any other frivolous, bogus lawsuit that comes up against a gun owner.     I live just outside of Philadelphia. I don’t travel to New Jersey. I won’t do business in New Jersey. Until New Jersey follows the intent of the Constitution of the United States, I refuse to spend any money there. I feel sorry for the residents who live there, but they have the power to change the policies that give more rights to criminals than law abiding citizens. It’s called the vote. Use it or lose it.

    I hope the USCCA takes a hard look at the executive order and considers litigation to challenge it! I am sure they will look very diligently at the pros and cons of expensive litigation. They obviously are taking a moment to pause and evaluate.
    We all know N.J. is very strict on concealed carry and will discourage it by whatever means they can legally use. So let us see what the evaluative process brings and what action may be considered by the USCCA and others who have chosen to withdraw because of the executive order. However, good to know CCW Safe has availability to cover the gaps.

    I am a Washington state resident and unfortunately I had to give up my USCCA protection because the Department of Insurance here did the same thing. I sent a letter to the insurance commission to protest this policy that they passed without any notice to state residents. They did respond with a letter stating because the “insurance” did not have a company in backing it in our state. It is still obviously unconstitutional because they only singled out the NRA and USCCA policies! Then they claim it is not against gun ownership. What a crock. More politically based rhetoric to crush the 2nd amendment,

      These blatant discriminatory laws should be challenged in court and abolished. They are totally unconstitutional. Can you imagine banning a company that sells life insurance? This is just another anti-gun scheme. I’m sure California will follow suit. San Jose already has a scheme to require gun owners to have liability insurance.

    It seems like “Phil Murphy“ just want honest citizens to be defenseless legally as well as physically. Let’s connect the dots, to drive a vehicle (which can be statistically more dangerous then firearms) we are legally required to have insurance. So It would stand to reason that having self defense insurance (especially for the oh so scary guns) would be wanted by all.

    Unbelievable!!!, again some politicians figure a way to screw over LAW ABIDING CITIZENS, Well if they can suspend our insurance coverage for improper use of our guns which HAS NOT been PROVEN in any way , shape or form, then I would put forward that ANY individual that has been ticketed, pulled over, or issued an appearance ticket to court for driving under the influence,,,,of ANY substance, have thier privileges of being insured REVOKED for DANGEROUS use of thier vehicle,,, Gun, vehicle BOTH can be improperly used and be dangerous to the point of LETHAL USE. Let’s see how they react to this,!!! And to having thier driving records revealed.

    We all know that stupidity is rampant in our elected officials. My wish is that there be a requirement for public office be a documented I.Q. level that matches the room temperature of the houses of Congress. However, I don’t appreciate a company that charges me money every month with the assurance of defending our rights cutting and running every time some gibbering squirrel in government attacks our Second Amendment rights. Time to “man up” USCCA, the fight is ON!

      Keep in mind that IQ tests by employers have been judged to be “discriminatory” because stupid people can’t pass them. How many politicians can pass an IQ test? Probably not even half of them.

    I live in Georgia, so does that mean we are not covered just in case we need the assistance? I hope that I never need to use it but with times like they are today, No one knows when they may need to use deadly force to protect yourself or a loved one or a stranger in need

      Allen, if you live in Georgia and are a member of USCCA your coverage is good across all states regardless if membership is being offered to residents of that state.

    CC insurance does not promote any more incidents than car insurance promotes MV accidents. The only time there is a “GUN” problem is when the accomplice holding the gun is a CRIMINAL.
